Residency requirements and grounds for divorce in Minneapolis

To file for a divorce, called dissolution in Minnesota, either you or your spouse must be a resident of Minnesota or a member of any of the armed forces stationed in Minnesota for 180 days prior to commencing the divorce.

Under the Minnesota law, either spouse can receive a divorce simply by stating in the Petition that there has been an irretrievable breakdown of the marriage. If both spouses agree to file for a divorce, they can file a joint petition, in which they agree in writing that the marriage may be dissolved.

After the Petition for Dissolution has been filed, either party can request temporary custody and child support orders, and orders to determine who pays marital debts on a temporary basis.

Property division in a Minnesota divorce
